NRA: Why we oppose Merrick Garland’s Supreme Court nomination

Last month, Second Amendment advocates and other patriotic Americans were shocked by the news of the sudden passing of Supreme Court Justice Antonin Scalia. His death was a tragedy for our Constitution and our country. For supporters of the Second Amendment, his death could result in the end of individual gun ownership in the United States.

In 2008, the Supreme Court answered the question of whether individual citizens have a right to own a firearm in their homes for self-defense. It was Scalia who wrote the majority opinion in that case, District of Columbia v. Heller. That landmark decision made clear that the Second Amendment guarantees an individual right to keep and bear arms. Shockingly, the decision was only 5 to 4. Two years later, in McDonald v. Chicago, Scalia joined Justice Samuel A. Alito Jr.’s opinion holding that that individual right is fundamental and applies to all Americans regardless of where they live. Once again, the decision was 5 to 4.

With Scalia’s tragic passing, there is no longer a majority of support for Heller and McDonald among the justices. Four justices believe law-abiding Americans have the right to own a gun for self-defense, including handguns. Four justices do not. The math is simple — and frightening. So it’s no exaggeration to say that the future of gun ownership hangs in the balance. Justice Ruth Bader Ginsburg, for example, was unequivocal in a speech to the Harvard Club in the District, saying that she looked forward to a day when a future court overturns Heller. The men and women of the National Rifle Association will not sit idly by and watch that happen.

The truth is that President Obama has lost all trust and credibility when it comes to law-abiding gun owners. During his two presidential campaigns, Obama repeatedly paid lip service to gun owners. But during his presidency, he has made his contempt for the Second Amendment unmistakably clear. When Congress refused to pass his gun-control proposals, he said they behaved shamefully and pledged to act without them. In addition, he has called his inability to enact nationwide gun control the biggest frustration of his presidency. Perhaps most revealing of his true intentions, Obama praised the gun confiscation policies of Great Britain and Australia — policies that forced their citizens to surrender lawfully owned firearms to the government for destruction, on pain of imprisonment if they refused.

Obama has already nominated two Supreme Court justices who oppose our fundamental individual right to own firearms safely and responsibly. The NRA knows better than to expect anything different with his third choice. On Wednesday, he nominated Judge Merrick Garland, a member of the U.S. Court of Appeals for the District of Columbia Circuit, to replace Scalia on the Supreme Court. From upholding a federal registry of law-abiding gun owners derived from the instant-background-check system created by the Brady Bill to siding with the District government by voting for a do-over in a Second Amendment decision that invalidated the D.C. handgun ban — exactly what the Supreme Court rightfully struck down in HellerGarland has proved,the NRA believes, he does not support the Second Amendment.

If Garland joins Ginsburg, Stephen G. Breyer, Sonia Sotomayor and Elena Kagan on the court, we believe they will overturn Heller and McDonald at the first opportunity. While claiming to support Heller during her Senate confirmation hearings, Sotomayor wasted no time in trying to overturn that historic decision. Kagan spent her time in the Clinton White House pushing for gun control. Breyer has made his opposition to Heller and McDonald abundantly clear through his dissents in those cases. And as mentioned previously, Ginsburg publicly spoke about her desire for a future court to overturn Heller.

Make no mistake about it: We believe this would mean the end of the fundamental, individual right of law-abiding Americans to own firearms for self-defense in their homes.

The overwhelming majority of Americans support their right to own a firearm for self-defense. Therefore, the NRA strongly opposes the nomination of Garland to the Supreme Court. Nothing less than the future of our Second Amendment freedom is at stake.

Hatchet-wielding man killed by customer at 7-Eleven
SEATTLE – King County Sheriff’s investigators say a man with a hatchet was killed after he tried to attack a 7-Eleven store clerk Sunday morning in White Center.
They say a customer was sitting inside the store drinking coffee around 5:45 a.m. when a man wearing a mask entered the store located near South 110th Avenue and 8th Avenue South.
The man began swinging a hatchet at both the customer and the store clerk, then attacked the clerk.
“We don’t know if the intent was to commit a robbery because the suspect didn’t say anything,” said King County Sheriff Sergeant Cindi West.
The customer pulled out his own gun and shot the man. The man died at the scene.
The store clerk suffered a minor injury to his stomach during the attack but, the owner says he’s doing OK.
Detectives say the customer does have a permit to carry a concealed handgun.
“We believe had this Good Samaritan not acted, we might have a dead clerk on our hands right now,” West said.
The case will be forwarded to the King County prosecutor’s office to determine if any charges will be filed.
The man shot has since been identified by the King County Medical Examiner as 43-year-old Steven Blacktongue.

Lewis’ book called “Weight of Glory”, which is actually a collection of Essays. I also Read “Do Hard Things” so I could discuss it with my children since they are reading it too this week. Just finished Created for Work: Practical Insights for Young Men by Bob Schultz as I need to be able to review with my Son as it was his last book to read. It is a great book for young to teenage boys.
Guns: EDC, Got in 3,000 Rounds of CCI 22LR, I found the best thing for loading Ruger MKII & MkIII Pistol, and other 22LR Pistol Mags, it’s called the Ultimate Cliploader by McFadden Machine. I cleaning up and I’ve Been Shooting my MKII Integrally Suppressed at Starlings. Picked up 9MM Ball two 500 Round Ammo Cans.

I guess I could call myself a long time listener.   One of my hobbies is running and I love to listen to your podcast if I find myself running on the treadmill.
I think you have been mentioning that you are working on a protection policy for your church.   I find myself in a similar position presenting an outline and an initial draft of a policy to the Deacons in the near future.
Have you run across any especially good resources for this that you could recommend.   I’m working my way through A Time to Kill which has really had an influence on my thinking.   However, I would love to see any examples or best practices that you have run into that you may be able to share.
Obviously churches don’t leave their protection policies on the internet so it is actually kind of challenging to find a lot of practical information.

Just thought I’d comment about the “sniper rifle” request your nephew I believe you said, made. First of all, I agree that he should get comfortable with what you have first and then begin to build up his own collection, but here is an idea. I’d prefer to build off a varmint platform with a .308 caliber which is a perfect longer range option for any purpose, especially hunting, and it will go out to 1,000 yards or so. Here’s my very affordable wishlist in a “longer” range platform. All told $770.00 without ammo. Good starter package, and then you can add the higher grade optics and triggers and such later. This is literally on my wish list from Sportsmansguide.com.

Senior Right-to-Carry permit holder shoots two attackers, WPVI, Philadelphia, Pa. 03/03/2016

A 65-year-old resident and his wife were walking home from their business in Philadelphia, Pa. when a pair of men attacked them. The resident, a Right-to-Carry permit holder, responded to the attack by drawing a .45-caliber handgun and firing at the assailants, striking them both and causing them to halt their attack. Police caught up with the attackers a short time later and transported them to the hospital.

The armed citizen did suffer injuries during the incident, with his attorney telling a local media outlet, “This was a matter of life or death. If he didn’t do what he did, and he didn’t have the training to do it. I think we would be at a funeral right now. Read a very good and hilarious book called Biscuits and Firecrackers  from my Good Friend and former Chiropractor Dr. Bob Darnell, he passed away last year and I miss him, his wife Constance finished the book he was trying to get it finished before he passed but wasn’t able to. I have laughed so hard my kids have come to check on me.  
Guns: EDC, Took my son to the range to shoot his Ruger MKIII 22/45 tactical red-dot sight, after tearing my thumbs off I ordered some more Hilljak speed Loaders for the Ruger MK II & III’s, holster, laser bore sighted was hitting targets without having to adjust the sights. Got to spend some time with my daughter teaching her how to shoot her Genesis Bow. Spent last Saturday in Louisville for my KY CCDW Re-Cert Instructor class, it was a waste of $50 and a Saturday. Did pick up some sweet Microtech Knives.

The Garden
An old man lived alone in Russia. He wanted to dig his carrot garden, but it was very hard work. His only son, who would have helped him, was in prison for bank robbery. The old man wrote a letter to his son and mentioned his predicament. Shortly, he received this reply,” For HEAVEN’S SAKE Dad, don’t dig up that garden, that’s where I buried the Money!” At 4 A.M. the next morning, a dozen policemen showed up and dug up the entire garden, without finding any money. Confused, the old man wrote another note to his son telling him what happened, and asking him what to do next. His son’s reply was: “Now plant your carrots, Dad. It’s the best I could do from here.”

One small addition to your comment on Federal Gun Free Zones. You were absolutely correct that there is a Federal Law it is still active – however there is an exception that if a person is licensed by the state (and had to go through a background check) – then they are exempt from this law.

You are also correct that many states have laws that outlaw it – but for what it is worth Kansas is also one that allows it – although most all schools are posted with no gun signs (but not all).

`(B) Subparagraph (A) shall not apply to the possession of a firearm–
 `(i) on private property not part of school grounds;
 `(ii) if the individual possessing the firearm is licensed to do so by the
 State in which the school zone is located or a political  subdivision of
 the State, and the law of the State or political  subdivision requires
 that, before an individual obtain such a license, the law enforcement
 authorities of the State or political subdivision verify that the individual
 is qualified under law to receive the license;
 `(iii) which is–
 `(I) not loaded; and
 `(II) in a locked container, or a locked firearms rack which is on a
 motor vehicle;
 `(iv) by an individual for use in a program approved by a school in the
 school zone;
 `(v) by an individual in accordance with a contract entered into between
 a school in the school zone and the individual or an employer of the
 individual;
 `(vi) by a law enforcement officer acting in his or her official capacity; or
 `(vii) that is unloaded and is possessed by an individual while traversing
 school premises for the purpose of gaining access to public or private
 lands open to hunting, if the entry on school premises is authorized by
 school authorities.

Property manager shoots burglar, KLAS-TV, Las Vegas, Nev. 02/26/16

 locksmith called the property manager for a home in Las Vegas, Nev. to alert them that there was a person in the house. The property manager went to the home and checked the front and backyard of the property. While in the backyard, the property manager encountered a burglar and responded to the threat by drawing a gun. An altercation ensued, during which the burglar was shot and killed. Police discovered tools inside a backpack, which they believe the burglar used to break into the house. God: Been doing my daily devotional, Piper and sportsman daily devotional. Went to Buckhead Church in Atlanta Sunday and saw my buddy get baptized. Huge church that is part of North Point ministries.
Guns: EDC. Got the Browning BAR Safari 7 mm. Went to a Georgia NRA meeting Saturday and watched the grant process for the money raised by Friends of the NRA. Also got a present at the door today. Several of the new Crossbreed holsters. Looking forward to trying them all out.

Troy:
God: Reading Through the bible in a year ESV Bible App, Finishing tomorrow a free 30 Day bible study titled  “Lord Hear Our Cry” by Jack Graham the Bible App or at Bible.com, Got to worship sunday and watched the children’s building in the video room Wednesday. Finished the rough draft of the safety team, working on the security team protocols now hope to finish it by next Wednesday.
Guns: EDC, Set up my sons Christmas present Ruger MKIII 22/45 tactical red-dot sight, holster, got it laser bore sighted waiting for it to stop raining/snowing/sleeting so we can get to the range, he’s getting more excited about handguns now, and wants me to build him a sniper rifle. Shot some starlings with the Benelli SuperNova, Going this Saturday for my KY CCDW Re-Cert Instructor class.

Message: Hello! I can’t recall which one of you said this, but you were discussing a recent story about a CCW person coming to the aid of a police officer near a school. One of you stated that you were wondering if the altercation actually occurred on school property. Your reason for the query was that you believe it is federal law that schools are gun-free zones and it is illegal to carry a gun onto any school property. You are not correct at all. It is true that many states, probably including your own, have a law barring guns from school property, but certainly not all. I live in Oregon and it is perfectly legal to carry my concealed firearm onto school property, provided I have my CHL. I’m sure that many states are like this. It is wrong to put out information that is incorrect about legal gun rights. I believe it is wrong for a state to have such prohibitions, as I’m sure you do, too. One small way we can help our rights is for gun owners and CCW holders to know that schools being GFZ’s is not normal and is not a foregone conclusion. It is not federal law that schools be “gun-free”, but state law. Perhaps we can get this changed in every state! It’s for the children!!

Disabled 71-year-old Tony Pitts was watching TV in bed at home in Hickory, N.C. when he heard his sliding glass door shatter. Pitts retrieved a .22-caliber pistol, went to investigate and saw a man coming through the broken door. Pitts responded to the threat by firing at the criminal, striking him twice. The home invader was taken to a hospital and is reported to be in stable condition.
Following the incident, Pitts told a reporter, “I didn’t want to but had to… If I hadn’t shot him, he might have shot me. I don’t know.” A friend of Pitts was supportive, adding, “He did the right thing I would have done the same thing… These people are dangerous you know. Facebook is not buying MeWe, they (MeWe) actually has posted about this a couple of times.  I do agree, it has taken me a couple of days to figure it out.  If y’all decide to get on there, contact me, I try to post things to help you get the site figured out.  There are a good number of gun trader sites that have moved over to MeWe.  I’m just trying to keep folks together.  I have a gundistrict.com account but it’s not as easy to operate, at least to me. Hopefully we, the gun community, will get moved to one spot so that our voice will be heard.

Armed Citizen saves police officer during violent attack, Philadelphia Daily News, Philadelphia, Pa. 02/10/16

An officer was attempting to break up two teens involved in an altercation near Upper Darby High School in Upper Darby Township, Pa. when one of the teens attacked the officer. Soon after, the other teen began attacking the officer, and then a crowd that had gathered to watch the fight advanced on him as well. A resident of the neighborhood, and Right-to-Carry permit holder, became aware of the situation, retrieved a gun and confronted the mob. The resident was able to stop the group from attacking the officer until additional police could arrive.

Following the incident, Upper Darby Police Superintendent Michael Chitwood told a local media outlet, “If it wasn’t for the good Samaritan stepping forward, he’d have been dead meat… There’s no doubt they would have attacked him.” (Philadelphia Daily News, Philadelphia, Pa. 02/10/16)
